The right compensation for your building project

Whether residential and commercial construction, logistics, road and rail projects, grid expansion, wind energy or ground-mounted photovoltaics, anyone who significantly affects nature and landscape must offset or replace the impact under sections 13 to 15 of the Federal Nature Conservation Act (Bundesnaturschutzgesetz). Compensation is therefore not a voluntary extra but a precondition for the permit.

greeNature takes on this compensation management in full. You draw on our own land portfolio of more than 10,000 hectares and use eco-points from officially recognised eco-accounts. Where special species protection is required, we plan and implement CEF and FCS measures. Where forest is taken up, we additionally take on replacement afforestation under state forestry law.

Three obligations that are often considered separately

A building project rarely triggers just one obligation under nature conservation law. As a rule, several areas of law apply alongside one another, and this is exactly where most delays arise.

Impact mitigation regulation. The assessment of the impact produces a compensation requirement that must be covered through land or through eco-points. The relevant assessment procedure is that of the state, the BayKompV in Bavaria, or the BKompV for projects under federal jurisdiction.

Special species protection. Regardless of the assessment, § 44 BNatSchG prohibits the destruction of breeding sites and resting places of protected species. Advance CEF measures must be effective before the impact takes place. This is the most common time-critical requirement in the whole procedure.

Forestry law. Where forest is cleared and converted, state forestry law requires replacement afforestation. This obligation exists in addition and is not settled by compensation under nature conservation law.

Good to know

The complete compensation management, across all the areas of law involved. This includes compensation and replacement measures under the impact mitigation regulation, replacement afforestation under state forestry law, advance species protection measures under CEF and FCS, and the associated land procurement and legal securing. We handle coordination with the lower nature conservation authority, the forestry authority and other relevant authorities, implement the measures, document them so they can be audited, and take on management and performance review for the entire commitment period. You have a single point of contact and a single contract instead of a chain of separate trades.
As early as possible, ideally as soon as the scope of the impact is roughly foreseeable and even before the impact assessment is finalised. There are two reasons for this. First, the required spatial link determines which areas can be considered at all, and availability in the natural region affected can be checked early. Second, CEF measures under species protection law need a lead time, because they must be effective before the impact takes place. Anyone who only plans this lead time after the permit decision has been issued loses an entire growing season. Early involvement costs little and prevents exactly this delay.
Rarely on technical grounds, almost always on land and time. Four patterns are typical. The impact assessment is complete, but there is no available land in the required natural region. The species protection assessment comes too late, so the CEF measure is not effective in time. The replacement afforestation is overlooked because it falls under a different area of law. Or the measure is implemented, but its permanent securing in the land register has not been settled. All four points can be avoided if they are addressed early in the procedure.
This is decided by the permitting authority, not by the preference of the project developer. If the authority accepts numerical coverage from a recognised eco-account, eco-points are generally the faster and more predictable route, because the measure is already implemented and assessed. If, on the other hand, the authority requires a close spatial and functional link or specific habitat types, a specific area is needed. Often the answer is a combination, for example eco-points for the general compensation requirement and your own area for the species protection requirements. We clarify this with the responsible authority in advance.
Yes, and this is a key part of the service. Implementation is followed by establishment management, then permanent ongoing management, accompanied by performance reviews at the intervals set out in the permit decision. The reports are provided to the authority in an auditable form. If a measure does not develop as planned, for example due to weather, browsing damage or invasive species pressure, we take corrective action without you having to place a further order. For you, this means the obligation does not remain a residual risk within your organisation after the permit has been granted.

Projects like these bring their own requirements: long routes spanning several districts and federal states, different assessment procedures per section, considerable coordination effort with several lower nature conservation authorities, and documentation that has to remain robust over decades.
