Assessment under SächsÖKoVO / Ökokonto

Saxony extends from the ridge areas of the Erzgebirge and the Elbsandsteingebirge in the south, across the central Saxon hill country, to the Leipzig lowland basin and the Oberlausitz in the north. This range of landscapes, soils and biotope types determines which areas are suitable for ecological upgrading and how high the compensation potential is in each individual case.

The legal framework for compensation and replacement is the statutory impact mitigation regulation under §§ 13 to 15 BNatSchG, supplemented by the Saxon Nature Conservation Act. Anyone who significantly impacts nature and landscape must refrain from avoidable impairments and compensate unavoidable ones through compensation or replacement measures. Saxony implements this via the Saxon Eco-Account Ordinance (SächsÖKoVO), which allows upgrading measures to be carried out in advance, recorded as credit, and later credited towards specific impacts.

Assessment is carried out under a biotope value method based on the Recommendation on the Assessment and Balancing of Impacts in the Free State of Saxony. The districts and independent cities, as lower nature conservation authorities, are responsible for reviewing, approving and maintaining the compensation area register. For projects relevant to species protection, the requirements of special species protection under § 44 BNatSchG also apply, frequently combined with advance compensation measures (CEF measures).

  • The Saxon Eco-Account Ordinance (SächsÖKoVO), in force since 1 August 2008, governs the creation and crediting of compensation credit and is decisive.
  • The assessment follows a biotope value method under the Recommendation on the Assessment and Balancing of Impacts in the Free State of Saxony; the creditable value is the difference between the target and initial condition.
  • Approval and maintenance of the compensation area registers rest with the lower nature conservation authorities of the districts and independent cities.
  • For projects approved under federal law (for example in the transport or energy sector), the Federal Compensation Ordinance (BKompV) may apply instead of the state procedure.
  • Special species protection under § 44 BNatSchG often requires CEF measures for affected species to maintain the ecological function (with reference to FCS in the case of derogations).
