Assessment under SNG / BNatSchG (Ökokonto)
Saarland is Germany's smallest territorial state, yet exceptionally diverse. Between the Saar-Nahe-Berg- und Hügelland, the wooded heights of the Hochwald in the Hunsrück, the shell-limestone slopes of the Bliesgau with its UNESCO Biosphere Reserve, and the floodplains along the Saar, very different habitats meet within a small area. This density makes careful assessment of impacts and their compensation particularly important.
Legally, statutory nature-conservation compensation in Saarland is based on the impact mitigation regulation of §§ 13 to 15 BNatSchG in conjunction with the Saarland Nature Conservation Act (SNG). Anyone who significantly impairs nature and landscape must refrain from avoidable impairments and offset or replace unavoidable ones. Assessment is carried out via a biotope value method that maps the condition of an area before and after the measure in value points.
The eco-account governed by § 30 SNG allows upgrading measures to be implemented in advance and credited in a statewide register. This creates temporal and spatial flexibility to decouple compensation from the project. For projects approved under federal law, such as cross-regional transport or energy corridors, the Federal Compensation Ordinance (BKompV) may additionally apply.
