Assessment under Ökokonto-VO NRW

North Rhine-Westphalia extends from the Lower Rhine Plain and the Westphalian Bight to the upland areas of the Eifel, Bergisches Land, Sauerland and Siegerland, as well as the Weserbergland with the Teutoburg Forest. In between lie densely populated conurbations along the Rhine and Ruhr. This mix of intensively used areas and valuable natural landscapes shapes both the demand for and supply of compensation land in the state.

The legal basis for compensation is §§ 13-15 BNatSchG and the North Rhine-Westphalia Nature Conservation Act. In practice, the assessment of impact and compensation is carried out via a biotope value method, mostly following the numerical assessment of biotope types issued by the LANUK. The existing and planned condition are converted into value points, referred to as eco-points, and the compensation requirement results from the difference. For advance measures, NRW maintains an eco-account under § 32 LNatSchG NRW on the basis of the Eco-Account Ordinance.

Alongside the impact mitigation regulation, the special species protection under § 44 BNatSchG must be observed. Where breeding sites and resting places are affected, CEF measures safeguard the ecological function in advance. The Federal Compensation Ordinance (BKompV) may additionally apply to projects approved under federal law.
