Assessment under ÖKVO

Baden-Württemberg is one of Germany's most naturally diverse states. The range extends from the warm Oberrheingraben, via the Schwarzwald as the largest contiguous upland range, to the Schwäbische Alb with its limestone cliffs, juniper heaths and beech forests. Added to this are the Alpine foothills around the Bodensee and the river and hill landscapes of the Neckar, Kraichgau and Odenwald. This diversity also shapes the requirements placed on compensation, because compensation measures must suit the natural region concerned.

The legal basis for every compensation measure is §§ 13 to 15 BNatSchG. Anyone who has an impact on nature and landscape must refrain from avoidable impairments and offset or replace unavoidable ones. In Baden-Württemberg, the assessment is set out in detail by the Eco-Account Ordinance (ÖKVO). Impact and compensation are expressed in eco-points, each biotope type is assigned a value per square metre, and the upgrading results from the difference between the initial and target condition.

The eco-account allows measures to be carried out before a specific impact occurs, with the resulting eco-points credited towards later projects. This decouples compensation from the impact in terms of timing and creates planning certainty. Project developers without their own land can draw on approved measures carried out by third parties. Alongside the impact mitigation regulation, the special species protection under § 44 BNatSchG must also be observed, for example through advance compensation measures (CEF measures) that safeguard the conservation status of the species affected.
